Terms & Conditions.

These Terms & Conditions govern your access to and use of the CarLer website, CarLer Instructor application, CarLer Learner application and associated CarLer services.

CarLer is operated by RD2SUCCESS FAST TRACK LTD in the United Kingdom. Please read these Terms & Conditions carefully before using CarLer.

1. About CarLer

CarLer is a technology platform designed to support driving instructors and learner drivers.

The CarLer services include the CarLer website, CarLer Instructor application, CarLer Learner application and associated functionality made available through those services.

2. Acceptance of These Terms

By accessing, registering for or using CarLer, you agree to these Terms & Conditions and any policies that apply to the service, including our Privacy Policy.

If you do not agree with these Terms, you should not use CarLer.

Certain features may also be subject to additional terms presented when you use those features.

3. Eligibility

You must be legally capable of using the relevant CarLer service and entering into any agreements associated with your use of that service.

Learner drivers who are under 18 should use CarLer only in accordance with applicable law and any appropriate parental or guardian involvement that may be required.

Driving instructors using professional or business features are responsible for ensuring that they are entitled to provide the relevant driving instruction services.

4. User Accounts

Some CarLer functionality requires an account.

When creating or maintaining an account, you agree to provide information that is reasonably accurate and up to date.

You are responsible for maintaining the confidentiality and security of your login credentials.

You must not:

  • Share your password with unauthorised people.
  • Use another person's account without permission.
  • Create an account using false or misleading identity information.
  • Attempt to bypass CarLer account security.

Please contact CarLer Support promptly if you believe your account has been accessed without authorisation.

5. CarLer Instructor Accounts

CarLer Instructor provides functionality intended to help driving instructors organise aspects of their driving instruction activities.

Features may include, depending on the version of CarLer available:

  • Diary and lesson scheduling.
  • Learner management.
  • Lesson requests.
  • Calendar functionality.
  • Working areas.
  • Vehicle and transmission information.
  • Maps and navigation.
  • Communication functionality.
  • Payment functionality.

Driving instructors remain responsible for the operation of their own driving instruction business and for complying with all laws, professional requirements, insurance requirements, licensing requirements and regulatory obligations applicable to them.

6. CarLer Learner Accounts

CarLer Learner provides functionality designed to support learner drivers during their driving journey.

Features may include:

  • Connecting with relevant driving instructors.
  • Lesson organisation.
  • Instructor communication.
  • Learning and progress-related functionality.
  • Theory learning functionality.
  • Payment functionality.

Use of CarLer does not itself guarantee that a learner will achieve any particular driving standard, pass a theory test, pass a practical driving test or obtain a driving licence.

7. Driving Lessons and Bookings

CarLer may provide technology that assists instructors and learners in organising driving lessons.

Unless CarLer expressly states otherwise for a particular service, the actual provision of a driving lesson is an arrangement between the relevant driving instructor and learner.

The driving instructor is responsible for matters relating to their own services, which may include:

  • Lesson availability.
  • Lesson pricing.
  • Cancellation policies.
  • Vehicle availability.
  • Pickup arrangements.
  • Suitability to provide instruction.
  • Professional and regulatory compliance.

Learners should review and understand any terms provided by their instructor before purchasing or attending lessons.

8. Driving Instructors

CarLer is a technology platform and does not guarantee the availability of any particular instructor.

Where instructors offer services through or in connection with CarLer, instructors are responsible for ensuring that information they provide about themselves and their services is accurate and not misleading.

CarLer may take reasonable steps relating to platform quality or account verification, but users should not interpret the presence of an instructor on the platform as a guarantee of any particular outcome, availability or suitability.

9. Payments

CarLer may provide or facilitate payment functionality.

Payments may be processed using third-party payment providers such as Stripe or other providers made available through the service.

Third-party payment providers may apply their own terms, privacy policies and processing requirements.

Where a learner pays a driving instructor for driving instruction, the instructor remains responsible for the commercial terms applying to their own driving instruction service unless CarLer expressly states otherwise.

Users must not attempt to make fraudulent payments, reverse legitimate transactions dishonestly or misuse payment functionality.

10. Maps, Location and Navigation

CarLer may provide mapping, location or navigation functionality.

Location and mapping information can be affected by GPS accuracy, connectivity, mapping data, device settings, road changes and other factors outside CarLer's control.

Mapping and navigation functionality should be used only when it is safe and lawful to do so.

Drivers must always prioritise road conditions, traffic signs, traffic signals, applicable law and safe driving over information displayed by an application.

A driver must not interact with CarLer or another mobile application in a manner that distracts them from driving or breaches applicable road traffic law.

11. Theory and Learning Content

CarLer may provide theory-learning, educational or driving-related content.

Such functionality is intended to support learning and preparation.

CarLer does not guarantee that using theory or learning functionality will result in a pass in any official examination or driving test.

Users should also refer to current official information and requirements relevant to their driving test and licence.

12. Driving Test Results

CarLer cannot guarantee that any learner will pass a practical driving test or theory test.

Test results depend on the learner's ability, preparation, performance, official assessment criteria and other circumstances outside CarLer's control.

13. Communications

Where CarLer provides messaging or communication functionality, users must use that functionality responsibly.

You must not use CarLer communications to:

  • Harass, threaten or abuse another person.
  • Send unlawful or fraudulent content.
  • Distribute malware or malicious links.
  • Send unsolicited commercial spam.
  • Attempt to obtain passwords or sensitive financial information.
  • Engage in conduct that infringes another person's rights.

14. Acceptable Use

You agree not to misuse CarLer.

You must not:

  • Use CarLer for unlawful purposes.
  • Attempt unauthorised access to CarLer systems.
  • Interfere with the operation or security of CarLer.
  • Introduce viruses, malware or harmful code.
  • Scrape, copy or extract data unlawfully.
  • Reverse engineer CarLer except where applicable law expressly permits it.
  • Use CarLer to impersonate another person.
  • Use CarLer to commit or facilitate fraud.
  • Infringe intellectual-property or privacy rights.

15. Availability of CarLer

We aim to keep CarLer available and functioning reliably, but continuous or uninterrupted availability cannot be guaranteed.

CarLer may occasionally be unavailable due to:

  • Maintenance.
  • Software updates.
  • Technical problems.
  • Network or hosting failures.
  • Third-party service failures.
  • Security incidents.
  • Circumstances outside our reasonable control.

16. Changes to CarLer

We may update, modify, improve, replace, add or remove CarLer functionality from time to time.

This may be necessary for technical, commercial, security, regulatory or operational reasons.

The availability of particular functionality may vary between CarLer Instructor, CarLer Learner, operating systems, devices or application versions.

17. Third-Party Services

CarLer may interact with or rely upon third-party technology or services.

These may include:

  • Apple.
  • Google.
  • Payment providers.
  • Mapping providers.
  • Calendar providers.
  • Hosting and infrastructure providers.

Third-party services are subject to their own terms, availability and privacy practices.

18. Intellectual Property

CarLer, its branding, software, interface, designs, content and associated intellectual property are owned by or licensed to the relevant rights holder, except where otherwise stated.

Using CarLer does not transfer ownership of CarLer intellectual property to you.

You may use CarLer only for the purposes permitted under these Terms and applicable law.

19. User Content

Where CarLer permits you to submit information, messages, images, profile information or other content, you remain responsible for content you provide.

You must have the necessary rights and permissions to provide that content.

You must not upload unlawful, misleading, defamatory, infringing, abusive or malicious content.

20. Suspension or Termination

We may restrict, suspend or terminate access to CarLer where reasonably necessary, including where:

  • These Terms are materially breached.
  • An account is used fraudulently.
  • There is a security risk.
  • Use of CarLer may cause harm to another user or the platform.
  • We are required to do so by law.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to address the issue.

21. Closing Your Account

You may request closure of your CarLer account by contacting:

Account closure and deletion of personal information are also subject to the CarLer Privacy Policy and any information we may legitimately need to retain.

22. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms affects statutory rights that cannot legally be excluded or restricted.

Subject to those protections, CarLer is a technology platform and is not responsible for losses arising solely from matters controlled by independent users or third-party providers, including an instructor's independent driving instruction services.

We do not guarantee:

  • That CarLer will always be uninterrupted or error-free.
  • The availability of a particular instructor.
  • A particular driving-test or theory-test result.
  • The accuracy of third-party mapping information at all times.
  • The continuous availability of third-party services.

23. Consumer Rights

If you use CarLer as a consumer, you may have legal rights under UK consumer law.

Nothing in these Terms is intended to remove or restrict rights that cannot lawfully be excluded or limited.

Our processing of personal information is described in the CarLer Privacy Policy.

25. Changes to These Terms

We may update these Terms & Conditions when CarLer, our services, legal requirements or business operations change.

The latest version will be published on this page with an updated revision date.

Where required, additional notice may be provided for material changes.

26. Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer rights or legal protections that apply to you.

If you are a consumer resident elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.
